Conspiracy? or FRAUD!

Deliberate media hype to the American public of horror stories is, so far, very successful in its attempt to frighten American Citizens into paying a tax which the IRS admits is voluntary. Citizens unwittingly volunteered into the purview of the graduated Income Tax system by filing W-4 and 1040 Forms.

The Basics

The Law, the Internal Revenue Code, the Income Tax Regulations and the supreme Court all concur: " Compensation for labor, earned by an American Citizen, in any of the 50 States in a lawful occupation is not taxable! "

Read that AGAIN:

"Compensation for labor is NOT TAXABLE!"

Why do I think there has been fraud? - Right here:

"Because of what appears to be a lawful command on the surface, many Citizens, because of respect for the law, are cunningly coerced into waiving their rights due to ignorance." U.S. v. Minker, 350 U.S. 179, 187

("cunningly coerced?")

"All persons are presumed to know the law. If any person acts under any unconstitutional statute, he does so at his own peril. He must take the consequences." 16 AM JUR 177,178

("presumed?")

Fraud: "An intentional perversion of the truth for the purpose of inducing another in reliance upon it to part with some valuable thing belonging to him or to surrender a legal right; a false representation of a matter of fact, whether by words or by conduct, by false or misleading allegations, or by concealment of that which should have been disclosed, which deceives and is intended to deceive another so that he shall act upon it to his legal injury." Black's Law Dictionary

More Basics

The IRS operates under the Executitive Branch of our government.

This means :

• The IRS operates under Article I, Section 8 of our Constitution.
• An Article I Court CANNOT hear and determine law.
  It derives its only power from Article I, Section 8, Clause 17 of the Constitution.
• The Legislative Branch, under Article II, determines law,
• The Courts operate under Article III, the Judicial Branch.

The IRS is no more than a private company contracted for services (collection agency) by the Executive branch in behalf of the Federal Reserve Board. Article I Courts only power is to enforce "administrative procedures". (contract law, when applicaple)

"Legislation enacted by Congress applicable to the inferior federal courts in the excercise of the power under Article III of the Constitution CANNOT BE AFFECTED BY legislation enacted by Congress under Article I, Section 8, Clause 17 of the Constitution". D.C. Code, Title 11 at p. 13.

Guess what? The act of signing a W-4 Form and paying Income taxes is not voluntarily committed when an individual does so because an employer, IRS agent, official, or employee or accountant perceived to have knowledge of tax laws, has misled that individual into beliving that such a filing of a form or payment of Income taxes was required by a statute of law and that non-compliance would lead to imprisonment or the seizure of the presumed taxpayers property!

("Conspiracy" anyone?)

The fact is: NO SUCH STATUTORY REQUIREMENT ACTUALLY EXISTS, IN SUBSTANCE, IN LAW AND IN TRUTH, and this creates FRAUD. Therefore, the origional and subsequent W-4's and Income Tax Returns which were filed, prior to such knowledge, are all REVOCABLE. The Black's Law Dictionary definition of fraud (above), almost sounds as if it were written with the IRS specifically in mind.

If any government official, agency or employee committed unintential fraud, it is called Constructive Fraud. It is also Constructive Fraud if the agreement was entered into without full disclosure. (If the fraud was done knowingly, it is called Fraudulent Representation.) When one or more persons collaborate on this kind of misleading activity, it is called a conspiracy.

"If two or more persons conspire to injure, oppress, threaten or intimidate any citizen in the free excercise or enjoyment of any right or privledge secured to him, by the Constitution or laws of the United States, or because of his having excercised the same shall be fined not more than $10,000 or imprisoned not more than 10 years, or both; and if death results, they shall be subject to imprisonment for any term of years to life." 18 USC Section 241 (The Criminal Code)

Citizens must realize that once they have volunteered, they must implement the proper legal procedure to "un-volunteer". It is not as difficult as you might think. We, obviously, do not deny the fact that the government needs money to run our Country. We are merely objecting to the completely unAmerican and unConstitutional way they are appropriating it. We also need money to support our families, but we don't extort our neighbors to do it!

Most Citizens pay Income Taxes out of a patriotic duty to support America. The abhorrent truth is, individual tax dollars DO NOT support America! Instead, 100% of Individual taxes are supporting a privately owned and NEVER AUDITED banking institution, which cannot collect enough from the graduated income tax to even pay for it's operating costs.

You should now realize that paying the graduated Income Tax is about as patriotic as paying extortion money to the mafia!

Are you going to pay your extortion money again this year?

It is your LAWFUL Right, as a free Sovereign American, NOT to pay the graduated Income Tax. If you give up this Right, fearing the IRS may seize your property, remember this:
